The Benefits of Cold Fusion Hair Extensions

May 1st, 2008 by dotidipasquale

By Jane Seymour Hair extensions are used to thicken hair or add color, depth, length and texture to your hair. As one of the secrets of Hollywood stars, hair extensions has become one of the most popular treatments in improving how the hair looks, feels, moves, falls down and goes up. There are others ways to achieve hair improvement through adding hair. These include sewing, clipping, gluing and tubing. However, the most preferred method of hair weaving is hair extensions through fusion. Fusions hair extensions became popular because of its painless, non-surgical procedure that lasts only about fifteen minutes, but could provide longer lasting results of up to five to six months. If you wish to have extensions attached to your roots, then you might consider this method to produce a more natural look. Fusion can be used for either hot or cold fusions hair extensions. While hot fusion uses hot glue to attach the extensions, cold fusion hair extensions are attached by using keratin-based polymer that is attached to your roots one stand at a time. Instead of heat, this method works by using ultra sonic waves (or rapid impulses). The Popularity of Cold Fusion Hair Extensions Although cold fusion hair extensions are relatively a new option for hair weaving, it is becoming increasingly popular for people who love weft hair. Even though both hot fusion and cold fusion extensions provide lasting results with a more natural look, the popularity of cold fusion hair extensions is becoming more evident and this is for a valid reason. The traditional hot fusion uses hot bonding material to attach the hair on your roots. Because of this, some people have reported burns and scalp damage. On the other hand, since cold fusion hair extensions are attached using milder solution, there will never be any possible burning. Another advantage of cold fusion extensions is that it could last longer compared to extensions that were installed using hot fusion. In addition, due to the flexibility of keratin-based polymer, your extensions will never be stiff and unnatural-looking hair. When applied by a professional, cold fusion hair extensions will be indistinguishable from your natural hair. Since this hair extensions method uses no type of heat, they are ideal for people with thin or very fine hair. If you want to achieve natural looking, 100% human hair extensions that can match your natural hair color, then cold fusions extensions are the best option for you. With these kinds of extensions, you will have longer, thicker and plumper hair than you ever had before. Depression Cure: Tips on How to Draw from that Higher Power

April 28th, 2008 by dotidipasquale

By Foras Aje In spite of the immense technological advancements and inventions designed to make our lives easier, depression still exists and millions of people are still seeking a depression cure. With all the sources of entertainment around us, depression still lurks in the core of our very existence as humans. Why? Could it be that with all the technology and scientific breakthroughs that we have lost the very essence of our being as humans? That-being a deep connection with the Omnipotent. This may very well be the case. We work too hard, go at neck-breaking speeds in life to get things done and never take the time to relax and draw on the Higher Power inherent within us, it is no wonder over 25 million people in the United states are depressed and consequently seeking a depression cure to end their misery. Coming from a Christian background and adhering to most of its principles in my honest opinion, an answer when asking for a depression cure will be a re-connection with God, by perhaps the most powerful yet easy method that although it is as old as the mountains is still extremely effective till this day: Prayer. Dont approach it by thinking that you have to say some specific verses or a bunch of Thees and Thous. Thats not necessary, talk to your Creator as you would your best friend and let it all out. The next step will be to simply take the time out to relax. Im going to borrow from Yoga folks, and the pose here is the relaxation pose.It involves laying flat on a bed, and consciously breathing deeply and evenly in a ratio of 5:5:5 (inhalation, retention and exhalation). You may do this accompanying a clock or a metronome. Breathe evenly as thus for several minutes, now consciously make auto-suggestions to your body starting from the toes to relax by saying mentally: my toes are hereby relaxed, my feet are hereby relaxed etc Do this working to the crown of your head and make sure every organ you can think of is relaxed by this auto-suggestion. Now the best part, pick one of the following quotes depending on your spiritual beliefs and repeat this to yourself(or heck, pick them all and repeat one after the other) 1. I am that pure consciousness or self. 2. I can do all things through God who strengthens me. 3. They that wait upon God shall renew their strength. Repeat this mantra mentally till it seeps into your subconscious and it literally replaces the negative thoughts you may have about your problems, just as light always overcomes darkness. Now, turn to your right side, breathe evenly again, then arise and approach your day believing that you are refreshed and drawing upon that higher power for a depression cure. Friends, this is very important, that you believe you are healed, just like a child believes the pain felt earlier has been cured by Mom kissing it away. Yes, such a child-like faith is required. Child-like but folks, powerful! Its been written: According to your faith be it unto you (this is a basic law of successful living.) In addition to this, to co-operate with the Higher Power in healing you, youve got to meet this Power halfway. Make efforts to better yourself. Lets get back to the basics folks, exercise, eating right and positive thinking. In regards to a depression cure, you may have to supplement drawing upon that Higher Power with seeking good company, sources of laughter and a wise avoidance of those factors or people that bring you down. A depression cure is within reach, the power which has its roots in the Omnipotent and Unseen is right there inside of you. With the tips above, you can draw from it, solve your problems and lead a depression free life. Empower yourself with a depression cure that works, reconnecting with the spiritual forces around you. Great wonders exist in your mind. Tap into it and win. Foras Aje is an independent health researcher and founder of Bodyhealthsoul.com. Don’t Let Your Job Kill You - How To Fight Back When It Comes To Your Health

April 26th, 2008 by dotidipasquale

By Traci Ferguson, MD How many of you spend hours in front of your computer every day working on project after project for your boss, putting money in your boss or companys pockets, completing the work of two or three people in the course of a day and feel yourself slowly putting on the pounds? How many times have you skipped lunch or just grabbed a candy bar from the vending machine so you could finish your work and clock out on time? Take a look around your office and see how many other people are in your the very same boat as you are.whove put on countless pounds since they started working with you. Your company may even offer you health insurance but what your company should be doing is offering to stop its slow, methodical drain in your energy, in your health and just STOP KILLING YOU!! If your company offers a discount on a gym membership..then great for you! But for those of us struggling to find time in the day just to grab a bite to eat, whats the benefit of a gym membership if you dont have any time to go to the gym. For the majority of us who work for companies who dont have fitness centers on site, who dont subsidize fitness or gym memberships and who dont give you more than a few minutes each day for breaks then youll just have to take matters into your own hands and make the time to get more active while youre at work. Heres how I fight back when it comes to getting the exercise my body needs: 1. Take the stairs instead of the elevator when going up less than 3 flights. 2. Use a restroom thats farther away from my office to add an extra couple hundred steps each day. 3. Have walking meeting with colleaguesinstead of sitting down for a brief 5 to 10 minute meeting I conduct a mobile meeting killing two birds with one stone. 4. Keep a supply of water under my desk so I can still get my 64 ounces of water in a day. 5. Keep healthier snacks on hand, like rice cakes or multigrain bars to avoid going to the vending machine for a candy bar. This is only a small list of the things that I do to stay active during my workday. I will not let my job be the death of me. I’ll continue to fight hard each day to get healthy and stay healthy. So join me in fighting back. Make exercise an integral part of your workday and youll notice more energy, more productivity and a better sense of wellbeing. Origin of Collecting

April 24th, 2008 by dotidipasquale

By Richard Reeve Collecting goes back several million years and then some. Today we watch grown men on television digging holes in someones back garden and getting extremely excited about a piece of pottery or small adornment that is corroded beyond recognition that a long departed ancestor collected several million years ago. Our television archaeologists call in a mechanical digger to shift several tons of dirt to discover nothing and then explain to the viewer over the next hour exactly what all this means to us today and what our ancestors were like then. Most collectors now that it is not necessary to dig holes in other peoples gardens to find something of value, we have replaced holes with charity shops, junk shops and antique dealers though man appears to have a preoccupations with digging holes and hording, you only have to watch children digging up their parents favourite plants to realise it is a natural instinct and only need look at ourselves to realise collecting tat is inbreed. The signs are refusing to throw anything away and when we do we replace it with something similar that we brought at a bargain price.. There is a point in history that we know little of, did the caveman collect and if he did why? Initially our collecting instinct must have been that of the squirrel or the pack-rat hording food out of necessity and in preparation for a time experience had taught us that it would not be available. Our initial hording instincts may have been food related, the odd horde of nuts, dried fruit and berries and possibly a favourite stone to crack the nuts. As hunter gatherers man would have found it difficult to collect anything large as the energy required in moving it to follow the food would have outweighed its usefulness so whatever the caveman horded would have been lightweight, probably a favourite fur, the teeth form a good kill or a good club. All things we could wear or adorn ourselves with that had some use or link with the past. Then we got religion. Man probably had religion from the moment he set foot on earth, we need religion to explain the unexplainable otherwise we would not be able to cope with life as we move from one disaster to another. Having religion gives us another day or two to cope, religion provides a future, a better world and someone to blame for our ills even if that person is ourselves because we failed to follow a certain ritual that if we follow it in the morning when the sun rises life will get better. Religion needed to be portable, something we could carry as we followed the food from woods to plain, experience taught us to fast when following the food at certain times of the year, we could pray to the sun, moon, stars and wind. Places on our food route could be spiritual, trees set in a certain why to form a natural cathedral or rocks providing the same service. So whatever it was man initially collected had to be portable, could be worn or hung around our neck or attached to our body burning little energy. Perhaps those collections were a few teeth, seashells, small bones an unusual stone or piece of ore that linked us to better days, displayed our wealth and indicated to others we met that we were good hunters and providers, our display driving interlopers away without a fight or attracting new members to our clan and increasing the gene pool. At some stage during our evolution we discovered animal husbandry and farming, built elaborate shelters and settled down, then we discovered smelting and began make metal objects. Our religion became static so we made effigies we could place in our homes to protect us against evil spirits. As a community and humans we needed to maintain our links with the past so we appointed a community historian who collated and retained our history speaking it often to the people of our clan. Like the wheel no one is quiet sure who invented it and exactly when but the most important invention for collectors came about. It was an invention that created new industries, artists, the printing press, the retail industry, the junk shop, antiques markets, spirit level and possibly even the motorcar and certainly the flat pack industry, out of town shopping malls and Ikea, such a momentous invention was never recorded in history or attributed to one man it was the shelf. Of course before he invented the shelf he invented houses with square walls. Man in his infinite wisdom had created something he would regret for the rest of his and his male offsprings life, something he would be nagged about for several millennium, told that it was not level or secure. The woman of the man that first put up the shelf sat for days looking at it and wondered what her stupid man had invented, what use was it? After several days she realised he had only created something to gather dust and create more work so she placed a load of junk on it that someone had given her and forgot about it. Perhaps it was at the gods next celebration when the woman of the house invited neighbours round to exchange gifts and share food that the wives of the visiting men noticed the cheap gifts they had exchange the previous year had been given a place of prominence in the host home and felt out done. Arriving home after a night on the mead and a good meal the mens wives began nagging their husbands to build a shelf and why had they not thought of it first, their husbands did not love them as much as so and so loved his wife. The berated men called on their friend, the man they knew as Chris the Master of his tribe, the man who had invented the shelf and explained that their wives were carping on about his new invention and offered him several dozen sea shells and selected stones to enter their homes and build shelves. After several years of building shelves for his friends and family Chris the Master of his tribe was invited to distant villages to build shelves. To cope with the work he trained his male children and tribes children to build shelves and became known as Chris The Man you ask to enter your home to stop carping wives. This was soon shortened to Chris the Carp-enter and then Chris the Carpenter and the wives in celebration and in remembrance of his original name named a feast day after Chris the Master of his tribe that was soon shortened to Chris t Mas a day you invite your friends round to eat and exchange gifts for your shelf. That small invention lead to the creation of the bookcase, the display cabinet, the dresser and even the wardrobe and so man became a collector and invented more and more products to store his collections that probably lead to the invention of the stamp and then the postcard. I have been selling antiques and collectables online since 1999 having taken early retirement from working in the merchant banking industry. I had been collecting antique silver for several years, silver being my first love. My second loves is a tossup between books and postcards and have provided advice on postcards to several TV collecting programmes and have also written several articles on collecting and business banking for national newspapers. I am also asked by local auction houses to research unusual ceramics and marks. My website sells almost anything that is collectable, regrettably, there is insufficient time in the day to upload all the items I buy and could also be accused of hording as my home is also full of the junk I buy and many of the mistakes. http://www.collectable-postcards.com Article Source: http://EzineArticles.com/?expert=Richard_Reeve http://EzineArticles.com/?Origin-of-Collecting&id=447909 auto loans for bad credit credit score needed for a mortgage hartgrave and associates credit repair credit card offers for people with bad credit

10 Tips For Relieving Depression

April 22nd, 2008 by dotidipasquale

By Wambui Bahati 1. Eat life-giving foods. If you eat devitalized and lifeless food, it makes sense you will be devitalized and lifeless. Your body has nothing on which to draw to keep it energetic and vibrant. If you do not feel like cooking, then eat apples or other fruits or vegetables, sliced or whole. Even though you may crave sugar and junk food, these foods not only do not help in relieving depression, they make it worse. Buy and eat organic foods, if possible. It has not been determined how chemically treated and genetically altered foods affect us, so best to avoid them. 2. Know that you are not insane. Depression is a warning sign that something is wrong. It is a symptom that something is out of balance in your body, in your environment, or both. We live in an environment filled with toxins. There are wars, inequitable laws, financial pressures, and media overload. The list is unending. We are natural beings living in an unnatural world. This is the insanity. Our bodies, our minds, and our spirits are reacting to this insanity. Know that you are not insane. You are reacting to the insanity outside you. 3. Turn the TV off. Take a break from media overload. Turn the TV off and do not read the newspapers. Most of what you hear on TV and read in the papers is not good news. This is not the time to read and listen to sad stories and ponder devastating events you can do nothing about. 4. Fake it till you make it. Sometimes you need to work from the outside in. Act as if you are not depressed. How would you walk, talk or sit if you were not depressed? What would you do if you were not depressed? If Publisher’s Clearing House came to your door right now with a $5 million check, would you tell them to go away because you are too depressed? Fake it till you make it. Your brain does not know the difference between what is real and what is imagined. Imagine you are not depressed. 5. Dress up. Wear your good clothes. Do what you can to make yourself look and feel attractive. 6. Count your blessings. When you are depressed, sad and perhaps angry, being grateful is not the first thought that comes to your mind. However, this is the perfect time to count your blessings. This is the perfect time to remember there are people who would gladly trade places with you. We have so many things to be thankful for; however, we often take them for granted. With an attitude of gratitude, depression cannot thrive. 7. Drink water. You can survive many weeks without food, but only a few days without water. Dehydration will cause your body and your brain to shut down. Being happy and having a great attitude is impossible if your body is dehydrated. Drink plenty of water. One rule is to drink half your body weight in ounces each day. That is, if you weight 200 pounds, drink 100 ounces of water. Drink filtered or spring water if possible. The tap water in many of our cities contains chemicals and, again, we cannot be sure how these chemicals are affecting us. 8. Listen to motivational tapes. Do not leave your mind alone to do its “own thing.” Obviously, your self-talk is not serving you well at this time. Therefore, this is the perfect time to listen to someone else’s talk. Listen to motivational and inspirational tapes and music. Bombard your brain with uplifting thoughts from others. If you feel like reading, read uplifting and inspiring material. 9. Dance. The body needs to move. Get that blood flowing through your body and your brain. Your brain needs a good supply of blood in order to work properly. But when you are feeling depressed, the idea of exercising is not appealing. So, dance! Play uplifting and happy music. Play music that reminds you of happy times. Stretch out those parts of your body you are able to stretch. Move, move, move. Dance, dance, dance. Your body, your mind, and your soul will thank you. 10. Remember who you are. You are a precious entity in this great cosmic universe. You are a representation of God. There is nothing true of the greatest among us that is not true of you. You are magnificent. Sometimes we forget how wonderful we are. Have you? Wambui Bahati “Miss Inspiration” is a professional speaker and entertainer. College Freshman Pitfalls to Avoid

April 20th, 2008 by dotidipasquale

By Callista Neuharth A persons education is actually never completed. We are all lifelong learners. We do however, have formal education systems that are finite and well defined. An experience that is nearly universal in western societies is the experience of grade school and high school. These institutions do more than educate us in academics, of course. They also socialize us and are part of our life-education process: how to make friends, good decisions, establish personal standards, and so forth. Some children will continue their formal educations by going to directly from high school to a college or a technical school, and that is where most will have their first taste of true independence. Here again, the institution does so much more than merely academic education. How well prepared a graduate fresh out of high school is for the experience will quickly be revealed. There are classic pitfalls awaiting young college freshman. Food, money, study habits, recreation. Each of these areas requires attention for the young student to do well. Food: The reason for the term freshman fifteen is that suddenly the teenager is on his own with respect to food choices. Many students begin by making poor choices, and quickly put on extra pounds. Money: Students who have suddenly got to balance their own checkbook and make large payments on things like tuition and housing without prior experience and coaching about handling money are at a disadvantage that could be disastrous. Study habits: Some freshman arent prepared for the collegiate expectation of time outside of class devoted to study. They dont recognizing that its a full-time job. Recreation: There is no curfew and students living in dorms can be of drinking age, so alcohol is readily available. Many teenagers on their own for the first time are sorely tempted by the sense of freedom for experimentation. Knowing ahead of time about potential problem areas allows parents to help their college-bound children get better prepared. Making good decisions is obviously not something one takes a crash course to learn how to do. It is the habit of a lifetime, and as parents, we begin to teach our children to make good decisions by allowing them sufficient independence while they are still at home and directly under our care. The freshmen who were tightly restricted at home, and never encouraged to think for themselves, are generally the ones who go wildest as freshman. Theyve been given a taste of freedom they werent ready to handle. If a parent thinks that a graduate needs more time and maturity before going to college, it is wise to give that time. It isnt necessary to go straight from high school to college. Sometimes, it is better to see to our continuing education after expanding our life experience. The Science of Marketing

April 14th, 2008 by dotidipasquale

By Mary Eule Science n 1. a systemized knowledge derived from observation, study 2. a branch of knowledge, especially one that systematizes facts, principles and methods in order to produce solutions in some problem domain. As Webster Dictionarys definition suggests, marketing expertise is base on obtaining objective knowledge and using it to develop methodologies and principles. It all begins with gathering, managing, analyzing and systematizing information. Marketing is far more than tactics. A sound marketing strategy begins with analysis. Therefore the word science aptly reminds us that first-rate marketers do their homework by researching the marketplace, competition and customer preferences, just to name a few. The goal is to take a crap shoot and turn it into an informed decision. Is there still risk? Absolutely, but its greatly reduced. There are a number of textbooks devoted solely to the types, validity, merits, descriptions, etc. of various marketing research methods. Some are quite complicated, while others less so. Since research and analysis are particular interests of mine, Im tempted to provide you with specific details on each type. But youre in luck I will resist the pull. Nevertheless, it is important that you understand and consider that the operative word is knowledge- About: Yourself your abilities, goals, beliefs, work ethic, passions Your company strengths, weaknesses, resources, culture Your products/servicesquality, selection, value Your industrytrends, innovations, successes Your prospects ones that are already buying from you; ones who ought to be buying from you; and ones who are about to buy from you Your employees their goals, talents and expectations The economy and its effect on your those that your serve Your customersthe problems theyre facing; their buying habits; average transaction amounts; level of satisfaction; additional product/service requests; number of lifetime transactions, etc. Current events events that may affect your customers ability and/or desire to purchase The marketplace the whole universe of people who can use your product/service; those that can purchase it; and those you choose to serve Your competition what are they doing well and where are there opportunities for your company to shine The business climate general optimism or pessimism about business, particularly as it relates to your industry Your community local news and events which may impact your business positively or negatively There are two basic types of information you can gather, affectionately known as quantitative and qualitative data. Dont be intimidated by the names, because theyre really quite simple. Quantitative research provides you with measurable, objective, facts For instance, if you asked 10 people if they liked ice cream and 6 said yes then youd be correct if you concluded that 60% of respondents like ice cream. Caution: If your respondent numbers are low (like 10!) the information you receive is not valid and should not be used to generalize over a larger population. Your random (this is an important point your respondents must be selected randomly) sample must be large enough to be considered statistically valid. Qualitative studies are considered more exploratory. Usually a small number of respondents are asked to give their opinions on various subjects, products, companies, and the like. This data can be extremely useful but should never be used as a decision-making basis for key strategic or tactical activities. There are thousands upon thousands of great resources available for obtaining helpful information. Some of the best are: The Internet if you have access to the internet all you have to do is type logical keywords into one of many search engines (I like: www.dogpile.com) and youll be overwhelmed with information. Your local newspaper Its a wonderful way to keep abreast of local news, community events, national and international news, business and industry trends, competition, etc. The library volumes of references books on industries, commerce, research studies, consumer data, etc. Friends, neighbors, customers, family members stay abreast of their concerns, desires, frustrations, problems. Use their answers as a jumping-off point for further research. The Labrador Retriever - A Great Family Dog That is Friendly and Intelligent

April 10th, 2008 by dotidipasquale

By Carol Stack If you are considering a pet, you will definitely want to take a close look into a Labrador retriever. There are many reasons that this dog breed is becoming so popular with families these days and one of the biggest reasons is the fact that they are extremely friendly. Labradors make the perfect family dog because not only are they friendly, but they are a great dog for children as well. When you have children, it is almost a guarantee that they will at some point want a pet. You of course, want to choose a pet that is friendly and very gentle, which is why the Labrador Retriever makes a great dog for the entire family. Families also want a dog they can train not only in the basic manners of house breaking and other mandatory things, but also in fun things such as tricks. The Labrador Retriever learns very quickly. They are also very obedient dogs and live to serve their master. All of these great qualities combined make for the perfect family pet that everyone can enjoy both children and adults. Of course, owning a pet requires a lot of responsibility. It is a great way to teach your children from an early age the responsibilities of owning and caring for a pet. Each pet has their own set of requirements of needs and temperament; therefore, it is important that you learn as much as you can about them. With the Labrador Retriever, for example, they require a great deal of exercise. A very energetic pet, you will want to make sure that you take them on regular walks and give them ample space to run and play. Another thing about the Labrador Retriever is that they require plenty of attention. It is important that you make time for your lovable friend and play with him, pet him, and love him frequently. You will find that they crave human companionship and need it regularly. You want to make sure that if you have to leave on vacation, you have someone coming over to give him a little human interaction time. When choosing a pet, you also want to be aware of health problems that particular breed is prone to. With the Labrador Retriever, they are typically prone to elbow and hip dysplasia. Elbow dysplasia affects the joints in Labradors, which could range from mild forms of arthritis or severe forms, which could lead to the possibility of surgery to correct the problems. Hip dysplasia directly affects the joint in the hip. This could cause pain, arthritis, and even trouble walking or getting up. Labrador Retrievers are also prone to PRA and eye disorders. Overall, the Labrador Retriever makes an excellent pet for any family. They can be housed in any type of home, such as an apartment. However, you want to make sure they get plenty of exercise. A home with a decent yard is ideal for this dog breed. They are very obedient and faithful pets. It’s no wonder they are the most favorite breed in the United States and Canada. Carol Stack enjoys writing articles, especially about dogs. She lives with her husband, children, four dogs and seven cats in the United States. Carol and her daughter Christy have put up a website, http://www.christysdogportal.com that covers dog breeds, dog care, and dog training. Using Technology to Create a Year-Round Event

April 7th, 2008 by dotidipasquale

By Michelle Issing The conference that you have spent months planning went off without a hitch - your attendees, sponsors and exhibitors all left happy and the goals of the conference were accomplished. But now what? To get the most out of your conference start thinking about it not as just a three or four day event, but as a year-long event continually engaging your audience. Here are some great ways you can utilize technology to easily and effectively communicate with your attendees, potential attendees, exhibitors and sponsors to keep your conference going year-round. Podcasting Podcasting is fast becoming one of the most popular ways to distribute electronic media. Any form of electronic recording (video or audio) can be turned into a podcast for distribution over the Internet and can be replayed on a computer or MP3 player. Conference sessions can be recorded and offered as downloads from the conference website. This can be a valuable resource to attendees and a great way to let those that did not attend the conference see what they missed. Try releasing one session podcast a month or take one of the longer keynote presentations and break it up into smaller sections to create a podcast series. Other podcasting ideas include recording conference attendee testimonials or teasers for next years conference. If you already have speakers confirmed for next years event have them record a short segment about what they plan to speak on. As a sponsor benefit, offer sponsorships of podcasts to increase sponsor visibility throughout the year. Online Communities One of the most beneficial parts of attending a conference is networking and sharing ideas so why limit that experience to just the conference? There are several technology tools that you can easily set up to give this experience to your attendees year-round. The newest and most robust is a blog the next generation of online discussion forums. A conference blog offers a central location for interested parties to post messages that become on-going online conversations on many different topics. Individual discussion threads can be categorized by topic and date. Blog topics can parallel conference development activities such as venue selection, conference schedule, general session speakers as well as breakout session topics. This makes for a tremendous vehicle to attract interested individuals to your organization and conference. Targeted eNewsletters eNewlsetters are a great way to market an upcoming conference to your potential attendees, but why should everyone get the same one? If you have been able to track session attendance during past conferences or capture demographic information about an attendee during registration, you already have a goldmine of information. Use that information to create a segmented mailing list and create specific eNewletters just for them. This can be articles of interest, current events or even just a list of the upcoming conference sessions that they may be interested in. Small Claims Court -What’s it All About?

April 6th, 2008 by dotidipasquale

By Bob Sherman What matters can be heard in small claims court? Typically, you take an individual or business to small claims court because they owe you money. They may owe you money because they damaged your property or possessions (often in auto accidents), or broke an agreement such as a lease or loan repayment plan. Businesses are typically taken to small claims court because products they sold or services they provided damaged your property or possessions, repairs were inadequate, products were defective or failed to perform as advertised. The maximum amount of money you can recover in a small claims court varies from state to state. Currently the maximum amount of money you can ask for ranges from $1,500 to $15,000. You can search online for your state’s small claims court website by searching for a phrase like “Nevada small claims court” (use your own state name, of course). You should take a person or business to small claims court only after you have tried to resolve the dispute with them. Some states require that both parties appear before a mediator to attempt to agree on a resolution before hearing the case. Sometimes a neutral third party who listens to both sides can help you work out a solution. Up to 90% of cases about to be brought to a small claims court are resolved though mediation before actually appearing before a judge. If the matter cannot be resolved in good faith during mediation the case can be brought before the court. To start a small claims court case you contact the court clerk in the locality where the transaction occurred or where the defendant resides. The clerk will provide you with a complaint or affidavit form. You will provide the name of the individual or business you want to sue, the reasons why you want to sue, and the amount you seek. There is a fee for filing the small claims court affidavit. This fee typically includes the cost of serving the defendant (the person you are suing) with notice of the claim and the court date. The fee for filing your claim can often be included in the judgment amount should you win your case. In many states attorneys are not allowed in small claim courts. If either party to a small claims court action wants to be represented by an attorney in these states, the case is transferred to the district court. You can always consult an attorney outside of court to get the legal assistance and advice you need to prepare and present your case. In many small claims courts your case will be heard by a magistrate, commissioner or referee instead of a judge. This substitute for a judge is often an impartial attorney who will hear your case and render a decision. When you present your case in small claims court you should be well prepared. You should bring evidence and/or witnesses that support your side of the dispute. Evidence may include receipts, bills, contracts, warranties, advertisements, photos, diagrams, police reports or other documents. A small claims court case typically takes 10 or 15 minutes total. So you must be prepared to present your story and evidence quickly in a logical order. Start by introducing yourself and telling the judge briefly why you brought your case. Then begin to tell your story in chronological order. Your story should be focused on showing that the defendant has liability and caused damages. That is, you must show that the defendant is responsible to pay compensation for any damage you experience. And you must show the dollar amount of the damages you experienced. Your story should include details of your interaction with the defendant. Describe what you expected, what you received, and how much it cost to fix any problems that occurred. For example, if you claim that there was a breach of contract, you should be prepared to show that there was a contract, the contract was not fulfilled (there was a breach), and present evidence of costs you incurred to correct the breach. You may have documents that include a signed contract, photos that show the damage or lack of fulfillment of the contract, and bills you paid or estimates you received to repair the damage. Include brief descriptions of your interactions with the defendant in attempts to correct this matter. The defendant will also be able to present the other site of the case. There are always two sides to a dispute. And, it’s the judge who must decided if your story and evidence are better than the defendant’s. If your small claims court case goes well, you will be awarded a money judgment. You will be pretty happy with the decision and expect to be paid by the defendant. Often the defendant will agree to pay you immediately or agree to some payment schedule. If you receive your money you should consider yourself happy. Often small claims court defendants simply don’t pay. It is estimated that nearly 90% of defendants do not pay the complete amount of the judgment. If you do not receive the money owed you, there are options to get the court to help enforce your judgment. You can file additional forms with the clerk to have the defendant’s wages or bank accounts garnsihed or property seized for auction, or a lien placed on their real estate. Of course, you need to identify where the defendant works, their bank accounts, the property to be seized or their real estate. If this is now your interest, you’ll need to investigate the topic of judgment recovery.
